Recognition and ownership of the quilombola: legality not legitimized

Abstract

This paper is part of research conducted by Uniara / Incra - Contract / CRT / SP / No. 100.000/2010, and was intended to investigate the potential, the amount and types of land resources available in the State of São Paulo to Settlements. Conducted by research group Productive Development, Organisational, the use and identification of the Public Lands in the State of São Paulo covenant quoted raised in this case study of the whole procedure started and claimed by the municipality of Campinas between 2002 and 2004, filed by the Brazilian Army and with INCRA, which could be used for the public areas of the Remount Farm, located between Campinas and Valinhos "a project of land use for generating employment and income applicants Agrarian Reform and residents of the periphery of the city". Also tried to show the feasibility of the request, based on the constitutional order, the agrarian legislation and urban Brazilian legislation, but without effective indeed. Sought to reveal even go out on all the arguments in favor of both the Municipality of Campinas, at the time, as compared to the opinion (positive) of the Regional INCRA/SP. This opinion, forwarded to the higher spheres of government in Brasilia. Thus, the question addressed seeks to disseminate and bring the heat for future discussions, the lack of political will to unite efforts between various government agencies and public institutions for the realization of this partnership – undeniably innovative for Agrarian Reform
in the Metropolitan Region of State of Sao Paulo.
